Defendants hereby request that the Court (1) stay this case pending the outcome of the U.S. Department of Health and Human Services' planned rulemaking that may moot the case or limit the issues to be decided by the Court, or in the alternative, (2) stay briefing of plaintiffs' early summary judgment motion pending resolution of defendants' planned motion to dismiss.
